LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

March 29, 2011

TO:
Honorable Byron Cook, Chair, House Committee on State Affairs

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB3610 by Thompson (Relating to periodic rate adjustments by electric utilities.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Utilities Code to allow for the approval of a tariff or rate schedule in which a nonfuel rate may be periodically adjusted based on changes in the utility’s investment. The bill would require the Public Utility Commission to adopt rules to implement the provisions of the bill.

Based on the analysis of the Public Utility Commission, it is assumed that responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
