No fiscal implication to the State is anticipated.

The bill would amend Section 2154.004 of the Occupations Code to authorize a municipality to regulate the sale and use of fireworks within the corporate boundaries; and in the existing area outside those boundaries if the municipality prohibited or regulated fireworks in those areas prior to September 1, 2011. A municipality that annexes an area after September 1, 2011, may not adopt a regulation to prohibit a person from continuing to use land for the lawful sale and possession of 1.4G fireworks as defined by the provisions of the bill. The commissioners court would be authorized to regulate restricted fireworks under Section 352.051(c) of the Local Government Code.
