LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 27, 2011

TO:
Honorable Allan Ritter, Chair, House Committee on Natural Resources

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB3853 by Geren (Relating to the authority of a gas or electric corporation to use certain land to construct or operate a transmission line.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would prohibit a gas or electric corporation from constructing a transmission line over, under, across, or adjacent to land designated by the Legislature as a site of unique value for the construction of a water reservoir. If the gas or electric corporation that constructs a transmission line in violation of this prohibition would be required to need to remove, reconstruct, or relocate an existing transmission line to allow for the construction or operation of the reservoir. A reservoir project sponsor would not be liable for relocation costs.

The bill's passage is not expected to result in significant costs to the Railroad Commission or the Public Utility Commission.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
