April 2, 2011

TO:
Honorable Harvey Hilderbran, Chair, House Committee on Ways & Means

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HJR99 by Ritter (Proposing a constitutional amendment authorizing the legislature to exempt from ad valorem taxation real property leased to certain schools organized and operated primarily for the purpose of engaging in educational functions.), As Introduced

No fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $105,495.

The resolution would propose an amendment to Section 2(a), Article VIII, of the Texas Constitution, to authorize the Legislature to exempt from taxation any real property that is leased to a person for use as a school, as defined as 11.21 of the Tax Code, for educational purposes. This authorization would apply beginning with the tax year that begins on January 1, 2012.

Adoption of the proposed amendment alone would have no fiscal impact on the state, other than the cost of publication. Any loss of revenue would be attributable to the corresponding enabling legislation.

The proposed amendment would be submitted to voters at an election to be held November 8, 2011.

Local Government Impact

No fiscal implication to units of local government is anticipated.
