LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 30, 2011

TO:
Honorable Rene Oliveira, Chair, House Committee on Land & Resource Management

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HJR158 by Kleinschmidt (Proposing a constitutional amendment releasing the state's claim of ownership or title to certain land in Lee County.), As Introduced

No fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $105,495.

The joint resolution would propose an amendment to release the state's claim of ownership or title to a specific parcel of land, including mineral interests, in Lee County, as described by the resolution.

Subject to voter approval, the bill would relinquish the state's claim of ownership or title, including mineral interests, to approximately 82 acres of land in Lee County. The estimated market value of the property is approximately $110,000 to $125,000, excluding any possible mineral interest value, according to the General Land Office. Although the value of land owned by the state would decrease by relinquishing this parcel, no revenue loss is included in this estimate because it is not known whether the parcel would otherwise be sold by the state.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
