No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to specify that the Juvenile Probation Commission and local juvenile probation departments are not law enforcement agencies and that juvenile justice agencies must compile certain kinds of criminal information in databases. The bill would permit a juvenile justice agency to release certain criminal information to an attorney representing a child if certain conditions are met. The bill would amend certain language related to a task force that studies gang activity, changing rules related to membership on the committee and collaboration with other government entities. The bill would take effect immediately if it received enough votes, and otherwise it would take effect September 1, 2011. The Texas Department of Criminal Justice, Texas Youth Commission, and Juvenile Probation Commission anticipate that the bill would not pose a significant fiscal impact to the state.
