LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

May 13, 2011

TO:
Honorable Lois W. Kolkhorst, Chair, House Committee on Public Health

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
SB546 by Deuell (Relating to the dispensing of certain drugs by physicians.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to the dispensing of certain drugs by physicians. The bill would allow a physician to dispense dangerous drugs to the physician's patients and charge the patients a reasonable fee for dispensing the drugs. The bill would require the Texas Medical Board to adopt rules to implement the provisions of the bill.

Based on the analysis of the State Office of Risk Management, there could be an impact from the provisions of the bill. However, this impact is not anticipated to be significant.

Based on the analysis of the Texas State Board of Pharmacy, the Texas Medical Board, and the Department of Insurance it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
