The bill would allow governmental entities to redact certain personal information requested under the Public Information Act (PIA) without requiring a decision from the attorney general. Specific types of personal information referenced in the bill include: vehicle license data; vehicle registration data; personal identification data; and credit card, debit card, charge card, and access card numbers. The bill would clarify the determination of when a PIA request is officially received by an entity.
The bill would allow requestors receiving redacted information to seek an attorney general's decision. The Office of the Attorney General would establish procedures and deadlines for this appeal process and would be required to issue a decision on the requestor’s appeal not later than the 45th business day after receiving the requestor’s request for a decision.
The bill would take effect September 1, 2011 and apply only to requests received on or after that date.
