No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code to require businesses that sell tires to render certain tires unusable on a motor vehicle according to guidelines included in the bill. The bill would scrap tire transporters to file a bond with the Texas Commission on Environmental Quality. The bill includes guidelines relating to the storage of scrap tires. The bill would create civil penalties for violations of the provisions of the bill. The bill would take effect September 1, 2011. The Comptroller of Public Accounts (CPA) indicates the fiscal impact of the civil penalty and the bond provisions included in the bill cannot be determined but this analysis assumes the impact would be insignificant. No significant fiscal impact to the state is anticipated.
