SB789 by Harris (Relating to the duration of a protective order against family violence.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code to allow family violence protective orders to have a duration longer than two years if the court finds the person restrained by the order (1) caused serious bodily injury to the applicant or a member of the applicant's family or household; or (2) was the subject of two or more prior protective orders.  The bill is not anticipated to have a significant fiscal implication to the court system.  The Office of the Attorney General anticipates any additional work resulting from the passage of this bill could be reasonably absorbed with current resources. The Department of Family and Protection Services (DFPS) reports regional attorneys, program staff, and county/district attorneys that represent DFPS would need to be updated on the changes. Additionally, changes need to be made to the protective order documents in IMPACT. This training and document updates can be handled through normal business practice. The bill would take effect September 1, 2011.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
