The bill would amend the Labor Code relating to a workers’ compensation data collection agent designated by the commissioner of workers’ compensation. The bill would allow the Texas Department of Insurance (TDI) to contract with a data collection agent and allow TDI to recover the cost by assessing and collecting fees from a workers’ compensation insurance carrier. While the cost of the data collection agent is unknown, the fees would cover the costs.
Based on the analysis provided by the Comptroller of Public Accounts, TDI’s operating account is self-balancing so any additional fee revenue collected on behalf of data collection agents would eventually result in an equivalent reduction in maintenance tax collections. It is assumed that all other duties and responsibilities associated with implementing the provisions of the bill could be accomplished within existing agency resources.
