IN RE:
SB1071 by Jackson (Relating to the exchange of certain state property in Brazoria County by the Texas Board of Criminal Justice.), As Introduced
The fiscal implications of the bill cannot be determined at this time.
The bill would require the Board of Criminal Justice to exchange property with an unnamed entity for a property of an equivalent fair market value. The General Land Office reports that a sale of property typically includes the ability for the agency selling the property to be reimbursed for expenses incurred where an exchange does not include such reimbursement. The parties involved in the land exchange would be required to bear the associated costs, which cannot be determined at this time.
The Texas Department of Criminal Justice (TDCJ) reports that costs would be dependent on the exchanged property's comparable production potential and proximity to a correctional facility to permit access to offender labor.
Local Government Impact
No significant fiscal implication to units of local government is anticipated unless the property exchange involves a local government entity.
