No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to enter into a comprehensive development agreement relating to managed lane improvements to a section State Highway 183. The authorization would expire on August 31, 2013. The bill would amend Section 371.101, Transportation Code, to specify contract provisions and procedures required to be included in a CDA of toll project entity to authorize the toll project entity to purchase the interest of a private participant in a toll project subject to the agreement. 

Based on the information and analysis provided by TxDOT, it is assumed that any costs or duties associated with implementing the proposed CDA would be accommodated within existing resources and through the allocation of the agency's existing highway planning and construction appropriations.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
