No significant fiscal implication to the State is anticipated.
The bill would amend Section 13.004 of the Texas Property Code, which deals with the effect of recording lis pendens (a notice that a legal action regarding real estate is pending). The proposed amendments add the requirement that indexing pursuant to Section 12.007(c) be completed before notice is effective under Section 13.004(a) and (b). Under current law, the notice is effective from the time it is filed for record. To the extent the bill would amend court procedures, no significant fiscal implication to the State is anticipated. The bill would take effect September 1, 2011.
