No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to exempt a district clerk in a criminal proceeding from the requirement of accepting and filing electronic documents and digital multimedia evidence if the district clerk’s electronic filing system does not have the capability of accepting electronic filings from a defendant and the system was established or procured prior to June 1, 2009. An exemption would no longer be permitted if the system was substantially upgraded or replaced.
