LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 15, 2011

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
SB1302 by Deuell (Relating to the offense of paying or receiving certain forms of compensation for assisting voters who vote early by mail; providing criminal penalties.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Election Code to prohibit paying or receiving compensation for assisting voters based on number of voters assisted or a quota and would create a Class A offense for a violation. A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both.

Local Government Impact

Costs associated with enforcement, prosecution and confinement would vary by locality, but could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
