No significant fiscal implication to the State is anticipated.

The bill would amend various sections of Chapter 443 of the Government Code related to the Preservation Board.  The bill would require a proposal for certain projects to be submitted to the Preservation Board at the earliest planning stages for review and comment; require the Preservation Board use gifts of property for the purpose specified by the grantor; and allow the Preservation Board to refuse a gift of property.   In addition, the bill would allow the Preservation Board to:  transfer funds from the Capital Renewal Trust Fund to any account in the Capitol Fund; include indirect costs in a deposit required for the use of the Capitol or its grounds; and establish, maintain and participate in non-profit organizations to raise funds for the Preservation Board. 
 
The bill would allow the Governor, Lieutenant Governor, and the Speaker of the House of Representatives as a member of the Preservation Board, to authorize a designee to act and vote on each of their behalf during a board meeting; and would authorize the governor’s designees to be the chairman of the board. 
 
The bill would take effect immediately if it receives a vote of two-thirds, otherwise the bill would take effect September 1, 2011.
 
The Capital Renewal Trust Fund and the Capitol Fund are funds outside the state treasury. It is anticipated that any additional costs associated with implementation of the legislation could be absorbed within existing resources.
