No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to define an archeological cemetery as an unmarked or abandoned cemetery that has been designated as an archeological cemetery by the Historical Commission (Commission). The bill would prohibit the construction of improvements on a property in a manner that would disturb an archeological cemetery until the human remains interred are removed under a permit issued by the Commission. The bill would require the removal of remains from an archeological cemetery be supervised by a professional archeologist that meets the qualifications of the Commission. The bill would require written authorization by the Commission for a member of the public to access an archeological cemetery.
