LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 18, 2011

TO:
Honorable Tommy Williams, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
SB1604 by Seliger (Relating to weight limits on a vehicle loaded with certain agricultural products.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 621.508 of the Transportation Code to include gross weight rather than axle weight as a measure to be considered for the affirmative defense of operating over the maximum allowable weight by a vehicle transporting timber, pulp wood, wood chips, cotton, livestock, or other agricultural products in their natural state from the place of production to the place of first marketing or first processing.

Based on the information provided by TxDOT, it is assumed the provisions of the bill would not result in a direct fiscal impact to the state and any costs or duties associated with implementing the bill could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
