HB1707 by Gutierrez (Relating to the punishment for the offense of theft.), As Introduced

The bill would amend the Penal Code as it relates to the punishment for the offense of theft. Under the provisions of the bill, the threshold for theft punishable as a Class C Misdemeanor would be raised from less than $50 to less than $100. The bill would also change the threshold for theft punishable as a Class B Misdemeanor from $50 or more but less than $500 to from $100 or more but less than $500.

A Class C Misdemeanor is punishable by a fine not to exceed $500 (up to 180 days of deferred disposition; no confinement). A Class B Misdemeanor is punishable by confinement in county jail for a term not to exceed 180 days and/or a fine not to exceed $2,000.

For this analysis, it is assumed the number of offenders convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.
