HB3031 by McClendon (Relating to granting certain persons convicted of a felony deferred adjudication community supervision.), As Introduced

The bill would amend the Code of Criminal Procedure as it relates to community supervision for certain felony offenders. Under the provisions of the bill, certain 3g offenders (those who would also be eligible for deferred adjudication) would be eligible for shock incarceration and subsequent placement on deferred adjudication or temporary incarceration in state boot camp and subsequent placement on deferred adjudication. Offenders who are not eligible for deferred adjudication either because their offense makes them ineligible or because they have a previous conviction for an offense that would make them ineligible for deferred adjudication would not be subject to the provisions of the bill. In order to be placed on deferred adjudication community supervision after placement in prison or in a state boot camp under the provisions of the bill, a motion would need to be filed and granted within the specified time period.
 
Allowing offenders to be returned from incarceration and placed on felony deferred adjudication community supervision is expected to result in decreased demands upon the correctional resources of the State due to shorter terms of confinement in prison or state boot camp. Although the number of offenders who would be returned from incarceration (prison or state boot camp) and placed on felony deferred adjudication community is unknown, it is assumed the number of offenders not released under this statute would not result in a significant impact on the programs and workload of State corrections agencies or on the demand for resources and services of those agencies.
