Pursuant to a notice posted in accordance with Senate Rule 11.10 and upon a motion made by Senator Harris to suspend Senate Rules 11.10 and 11.18 to add House Bill 971, a public hearing of the Senate Committee on Business & Commerce was held on Saturday, May 21, 2011, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 8:30 a.m. There being a quorum present, the following business was transacted:

 

The chair laid out HB 3117 and recognized the Senate sponsor, Senator Watson, to explain the bill.

 

Senator Watson sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Carona moved that HB 3117 be left pending; without objection, it was so ordered.

 

The chair laid out HB 2643 and recognized the Senate sponsor, Senator Watson, to explain the bill.

 

Senator Watson sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.

 

There being no one present wishing to provide oral testimony for, on, or against on HB 2643,

Senator Carona moved that HB 2643 be left pending; without objection, it was so ordered.

 

The chair laid out HB 971 and recognized the Senate sponsor, Senator Fraser, to explain the bill.

 

Senator Jackson sent up Committee Amendment 1.

Senator Carona moved that HB 971 be left pending; without objection, it was so ordered.

 

The chair laid out HB 2284 and recognized the Senate sponsor, Senator Deuell, to explain the bill.

 

Senator Estes sent up a committee substitute; the chair recognized Senator Deuell to explain the difference between the committee substitute and the senate bill as filed.

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Carona moved that HB 2284 be left pending; without objection, it was so ordered.

 

The chair called up HB 2284 as a matter of pending business.

 

Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Lucio, Jr. moved that HB 2284 do not pass but that CSHB 2284 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 3 absent. Senator Watson submitted a motion in writing requesting unanimous consent to be shown voting aye on HB 2284.

 

Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair called up HB 2643 as a matter of pending business.

 

Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Lucio, Jr. moved that HB 2643 do not pass but that CSHB 2643 be reported back to the Senate with the recommendation that it do pass and be printed. The motion failed with a record vote of 3 ayes, 2 nays, 0 present not voting, and 3 absent. Senator Watson submitted a motion in writing requesting unanimous consent to be shown voting aye on HB 2643.

 

The chair called up HB 3117 as a matter of pending business.

 

Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Lucio, Jr. moved that HB 3117 do not pass but that CSHB 3117 be reported back to the Senate with the recommendation that it do pass and be printed. The motion failed with a record vote of 4 ayes, 1 nays, 0 present not voting, and 3 absent. Senator Watson submitted a motion in writing requesting unanimous consent to be shown voting aye on HB 3117.

 

The chair called up HB 971 as a matter of pending business.

 

Senator Jackson moved adoption of Committee Amendment 1; without objection, it was so ordered.

 

Senator Jackson moved that HB 971, as amended, be reported back to the Senate with the recommendation that it do pass and be printed. The motion failed with a record vote of 3 ayes, 2 nays, 0 present not voting, and 3 absent. Senator Watson submitted a motion in writing requesting unanimous consent to be shown voting nay on HB 971.

 

There being no further business, at 9:22 a.m. Senator Carona moved that the committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
