Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Business & Commerce was held on Monday, June 20, 2011, in the Betty King Committee Room at Austin, Texas.

The chair called the meeting to order at 10:00 AM. There being a quorum present, the following business was transacted:

 

The chair laid out SR 36 and recognized the author, Senator Whitmire, to explain the bill.

 

Annie Mahoney, representing Texas Conservative Coalition (TCC), registered in favor of the bill but did not testify.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Whitmire moved that SR 36 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

At 10:07 AM Senator Harris assumed the chair.

 

The chair laid out as a matter of pending business SB 3. Senator Carona moved that HB 3 be considered in lieu of SB 3. Without objection, it was so ordered.

 

Senator Carona sent up a committee substitute; the chair recognized Senator Carona for a motion to adopt the committee substitute. Without objection, it was so ordered. The chair recognized Senator Carona to explain the committee substitute.

 

Barbara Salyers, representing Senator John Carona, testified on the bill.

 

Matthew Nihiser, representing Chairman John Carona, testified on the bill.

 

David Mattax, representing OAG, testified on the bill.

 

Amanda Crawford, representing Attorney General, registered on the bill but did not testify.

 

Senator Carona moved to reconsider the vote by which the substitute for HB 3 was adopted. Without objection, it was so ordered. Senator Carona moved that CSHB 3 be withdrawn from consideration and HB 3 be left pending; without objection, it was so ordered.

 

Senator Lucio, Jr. submitted a motion in writing to be shown voting in favor of SR 36. Without objection, it was so ordered.

 

There being no further business, at 10:45 AM Senator Carona moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
