Pursuant
to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public
hearing of the Senate Committee on Education was held on Tuesday, March 8,
2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

Pursuant to the suspension of
Senate Rules 11.10 and 11.18 during the Senate session of
March
7th, 2011, the chair considered the following bill, SB 3.
The
chair called the meeting to order at 8:03 AM. There being a quorum present, the
following business was transacted:
At
8:04 AM Senator Patrick assumed the chair.
The chair laid out SB 872 and
recognized the author, Senator Shapiro, to explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list.
At
8:45 AM Senator Gallegos, Jr. assumed the chair.
At
9:03 AM Senator Patrick assumed the chair.
The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator
Patrick moved that SB 872 be left pending; without objection, it was so
ordered.
The
chair laid out SB 3 and recognized the author, Senator Shapiro, to explain the
bill. Senator Shapiro sent up a
committee substitute; the chair recognized Senator Shapiro to explain the
difference between the committee substitute and the senate bill as filed.
Senator Shapiro sent up Committee Amendment 1 to the proposed substitute and
moved adoption; without objection, the amendment was adopted. Senator Shapiro requested unanimous consent
to incorporate the amendment into the committee substitute; without objection,
it was so ordered.
At
9:19 AM Senator Shapiro resumed the chair.
The
chair laid out SB 443 and recognized the author, Senator Patrick, to explain
the bill. Senator Patrick sent up a
committee substitute; the chair recognized Senator Patrick to explain the
difference between the committee substitute and the senate bill as filed.
At
9:47 AM Senator West assumed the chair.
Witnesses
testifying and registering on SB 3 and SB 443 are shown on the attached list.
The chair moved that the public testimony be closed; without objection, it was
so ordered.
The chair left the
bills pending.
At 11:11 AM Senator
Shapiro resumed the chair. Senator Shapiro moved that the committee stand
recessed until 30 minutes after the adjournment of the Senate; without
objection, it was so ordered.
Senator Shapiro
reconvened the meeting at 12:46 PM.
The chair laid out SB 35 and
recognized Senator Patrick, in the absence of the author, to explain the
bill. Senator Patrick sent up a
committee substitute; the chair recognized Senator Patrick to explain the
difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved
that the public
testimony be closed; without objection, it was so ordered.
Senator Shapiro
moved that SB 35 be left pending; without objection, it was so ordered.
The chair laid out SB
764 and recognized the author, Senator Williams, to explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Patrick moved that SB 764 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The motion carried with
a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent. Senator
Patrick moved that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
The chair laid out SB
778 and recognized the author, Senator Williams, to explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the public testimony
be closed; without objection, it was so ordered.
Senator Shapiro moved
that SB 778 be left pending; without objection, it was so ordered.
At 1:27 PM Senator West assumed
the chair.
As a matter of pending business,
the chair resumed public testimony on SB 3 and SB 443. Witnesses testifying and
registering on the bill are shown on the attached list.
At 2:34 PM Senator Van de Putte
assumed the chair.
At 2:56 PM Senator Davis assumed
the chair.
At 3:09 PM Senator Van de Putte
assumed the chair.
The chair moved that the public
testimony be closed; without objection, it was so ordered.
The chair left the
bills pending.
Senators Carona
and Gallegos, Jr. requested unanimous consent to
be shown voting aye on SB 764; there being no objection, it was so ordered.
There being no further business,
at 3:47 PM Senator Van de Putte moved that the Committee stand recessed subject
to the call of the chair. Without objection, it was so ordered.
