Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 29, 2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:33 AM. The following business was transacted:

 

The chair laid out SB 27 and recognized the author, Senator Zaffirini, to explain the bill.  Senator Patrick sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 27 be left pending; without objection, it was so ordered.

 

The chair laid out SB 54 and recognized the author, Senator Zaffirini, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 54 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1094 and recognized the author, Senator Rodriguez, to explain the bill. Senator Davis sent up a committee substitute; the chair recognized Senator Rodriguez to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 1094 be left pending; without objection, it was so ordered.

 

The chair laid out SB 217 and recognized the author, Senator Huffman, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 217 be left pending; without objection, it was so ordered.

 

At 9:51 AM Senator Patrick assumed the chair.

 

The chair laid out SB 4 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be left pending; without objection, it was so ordered.

At 10:51 AM Senator Shapiro resumed the chair.

 

Senator Shapiro moved that the committee stand recessed until 30 minutes after the adjournment

of the Senate; without objection, it was so ordered.

 

Senator Patrick reconvened the meeting at 2:04 PM.

 

As a matter of pending business, the chair resumed public testimony on SB 4. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

At the authors’ request, SB 4 was left pending; without objection, it was so ordered. 

 

The chair laid out SB 6 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.

 

At 3:23 PM Senator Seliger assumed the chair.

At 3:50 PM Senator Shapiro resumed the chair.

 

The chair laid out SB 1214 and recognized the author, Senator Patrick, to explain the bill.  Senator Patrick sent up a committee substitute; the chair recognized Senator Patrick to explain the difference between the committee substitute and the senate bill as filed. Senator Patrick sent up Committee Amendment 1.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Shapiro moved that SB 1214 be left pending; without objection, it was so ordered.

 

At 4:33 PM  the roll was called, and a quorum was present. 

 

As a matter of pending business,  the chair laid out SB 27.  Senator Patrick sent up a committee substitute.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 27 do not pass but that CSSB 27 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business,  the chair laid out SB 54.  Senator Van de Putte moved that SB 54 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business,  the chair laid out SB 217.  Senator Van de Putte moved that SB 217 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

 

As a matter of pending business,  the chair laid out SB 1094.  Senator Patrick sent up a committee substitute.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 1094 do not pass but that CSSB 1094 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out SB 1214. Senator Patrick moved adoption of Committee Amendment 1; without objection, the amendment was adopted.  Senator Patrick requested unanimous consent to incorporate the amendment into the proposed committee substitute previously sent up; without objection, it was so ordered. Senator Patrick then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Carona moved that SB 1214 do not pass but that CSSB 1214 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 2 nays, 1 present not voting, and 1 absent. 

 

At 4:41 PM Senator Patrick assumed the chair.

 

The chair laid out SB 1383 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.

 

At 4:55 PM Senator Gallegos, Jr. assumed the chair.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

At 5:08 PM Senator Shapiro resumed the chair.

 

Senator Davis requested unanimous consent to be shown voting aye on SB 27, and SB 54, SB 217, and SB 1094; there being no objection, it was so ordered.

 

Senator Gallegos, Jr. requested unanimous consent to be shown voting aye on SB 27, and SB 54; there being no objection, it was so ordered.
