Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on
Education was held on Tuesday, April 5, 2011, in the Capitol Extension, Room
E1.028, at Austin, Texas.

The chair called the meeting to order at 8:37 AM.
The following business was transacted:
The chair laid out SB 291 and recognized the author,
Senator Watson, to explain the bill.
Senator Davis sent up a committee substitute; the chair recognized
Senator Watson to explain the difference between the committee substitute and
the senate bill as filed. Witnesses
testifying and registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without objection, it was so
ordered.
Senator Shapiro moved that SB 291 be left pending;
without objection, it was so ordered.
The chair laid out SB 975 and recognized the author,
Senator Hinojosa, to explain the bill.
Senator Davis sent up a committee substitute; the chair recognized
Senator Hinojosa to explain the difference between the committee substitute and
the senate bill as filed. Witnesses testifying and registering on the bill are
shown on the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
Senator Shapiro moved that SB 975 be left pending;
without objection, it was so ordered.
The chair laid out SB 746 and recognized the author,
Senator Davis, to explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the public testimony
be closed; without objection, it was so ordered.
Senator Shapiro moved that SB 746 be left pending;
without objection, it was so ordered.
The chair laid out SB 346 and recognized the author,
Senator Gallegos, to explain the bill.

matter of pending business, the chair
laid out SB 291. Senator Davis moved
adoption of the committee substitute; without objection, it was so
ordered. Senator Davis moved that SB 291
do not pass but that CSSB 291 be reported back to the Senate with the
recommendation that it do pass and be printed.
The motion carried with a record vote of 8 ayes, 0 nays, 0 present not
voting, and 1 absent. Senator Davis
moved that the bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
As a matter of pending business, the chair laid out
SB 746. Senator Seliger moved that SB
746 be reported favorably to the Senate with the recommendation that it do pass
and be printed. The motion carried with
a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Seliger moved that the bill be
recommended for placement on the Local & Uncontested Calendar; without
objection, it was so ordered.

SB 127. Senator Patrick moved to
withdraw the substitute and amendment to SB 127 that was previously sent
up. Senator Patrick sent up a new
committee substitute; the chair recognized Senator Patrick to explain the
difference between the committee substitute and the senate bill as filed. Senator Patrick sent up Committee Amendment 1
and Committee Amendment 2 and was recognized to explain the amendments. The resource witness testifying and
registering on the bill is shown on the attached list.
Senator Shapiro moved that SB 127 be left pending;
without objection, it was so ordered.
At 10:14 AM Senator Shapiro moved that the Committee
stand recessed temporarily; without objection, it was so ordered.
At 10:35 AM Senator Shapiro reconvened the meeting.
As a matter of pending business, the chair laid out
SB 1788. Senator Carona moved adoption
of the committee substitute; without objection, it was so ordered. Senator Carona moved that SB 1788 do not pass
but that CSSB 1788 be reported back to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record vote of 9 ayes, 0
nays, 0 present not voting, and 0 absent.
Senator Carona moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so ordered.
As a matter of pending business, the chair laid out
SB 127. Senator Patrick moved adoption
of Committee Amendment 1 and 2; without objection, the amendments were adopted.
Senator Carona requested unanimous consent to incorporate the amendments into a
committee substitute; without objection, it was so ordered. Senator Carona then
moved that the committee substitute be adopted; without objection, it was so
ordered. Senator Carona moved that SB 127 do not pass but that CSSB 127 be
reported back to the Senate with the recommendation that it do pass and be
printed. The motion carried with a
record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent.
Senator Carona requested
unanimous consent to be shown voting aye on SB 291, and SB 746, and SB 1349; there
being no objection, it was so ordered.
Senator Davis requested unanimous
consent to be shown voting aye on SB 127, and SB 1788; there being no
objection, it was so ordered.
Senator Seliger requested
unanimous consent to be shown voting aye on SB 127, and SB 1349, and SB 1788;
there being no objection, it was so ordered.
