Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Thursday, May 19, 2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

Pursuant to the suspension of Senate Rules 11.10 and 11.18 during the Senate session of

May 19th, 2011, the chair considered the following bills, HB 127, HB 359, and HB 1386.

 

The chair called the meeting to order at 8:35 AM. The following business was transacted:

 

The chair laid out HB 675 and recognized the Senate sponsor, Senator Lucio, Jr., to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that HB 675 be left pending; without objection, it was so ordered.

 

The chair laid out HB 1224 and recognized the Senate sponsor, Senator Huffman, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.   

 

Senator Shapiro moved that HB 1224 be left pending; without objection, it was so ordered.

 

The chair laid out HB 1610 and recognized the Senate sponsor, Senator Patrick, to explain the bill. Senator Patrick sent up a committee substitute; the chair recognized Senator Patrick to explain the difference between the committee substitute and the house bill as engrossed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that HB 1610 be left pending; without objection, it was so ordered.

 

The chair laid out HB 398 and recognized the Senate sponsor, Senator Hegar, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

At 9:06 AM Senator Patrick assumed the chair.

At 9:09 AM the roll was called, and a quorum was present.    

 

The chair laid out HB 1335 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the house bill as engrossed.  Witnesses testifying and registering on the bill are shown on the attached list.

 

At 9:15 AM Senator Patrick assumed the chair. 

 

At 9:18 AM Senator Shapiro resumed the chair.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that HB 1335 be left pending; without objection, it was so ordered.

 

There being no further business, at 9:28 AM Senator Shapiro moved that the Committee stand

recessed until after the adjournment of the Senate. Without objection, it was so ordered.

 

Senator Shapiro reconvened the meeting at 2:01 PM.

 

The chair laid out HB 359 and recognized the Senate sponsor, Senator Lucio, Jr., to explain the bill.  Senator Van de Putte sent up Committee Amendment 1.  Senator Lucio, Jr. was recognized to explain the amendment.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved to re-open public testimony on HB 359. The chair moved to close public testimony on HB 359; without objection, it was so ordered.

 

Senator Shapiro moved that HB 359 be left pending; without objection, it was so ordered.  

 

The chair laid out HB 127 and recognized the Senate sponsor, Senator Uresti, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

reconvened at Senator Shapiro’s desk.

As a matter of pending business, the chair laid out HB 1942.  Senator Van de Putte moved to withdraw from consideration the substitute for HB 1942 that was sent up on May 17th; without

objection, it was so ordered.  Senator Van de Putte moved adoption of the new committee substitute sent up in the morning portion of the meeting on May 19th; without objection, it was so ordered.  Senator Van de Putte moved that HB 1942 do not pass but that CSHB 1942 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.

 

As a matter of pending business, the chair laid out HB 359.  Senator Van de Putte moved adoption of Committee Amendment 1 sent up previously; without objection, the amendment was adopted.  Senator Van de Putte moved that HB 359, as amended, be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out HB 398.  Senator Van de Putte moved that HB 398 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out HB 675.  Senator Gallegos, Jr. moved that HB 675 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out HB 1224.  Senator Seliger moved that HB 1224 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

As a matter of pending business, the chair laid out HB 1386.  Senator Van de Putte sent up a committee substitute that was explained previously and moved adoption of the committee substitute; without objection, it was so ordered.  Senator Van de Putte moved that HB 1386 do not pass but that CSHB 1386 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 2 nays, 0 present not voting, and 1 absent.   

 

As a matter of pending business, the chair laid out HB 1610.  Senator Van de Putte moved adoption of the committee substitute sent up previously; without objection, it was so ordered.  Senator Van de Putte moved that HB 1610 do not pass but that CSHB 1610 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 1 nay, 0 present not voting, and 1 absent.

 

As a matter of pending business, the chair laid out HB 2247.  Senator Patrick moved that HB 2247 be reported favorably to the Senate with the recommendation that it do pass and be printed.
