Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on
Finance was held on Monday, April 18, 2011, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 9:00 AM.
The following business was transacted:
The chair laid out SB 1004 and recognized the
author, Senator Lucio, to explain the bill.
Witnesses testifying and registering on the bill are
shown on the attached list.
Senator Lucio, Jr. assumed the chair.
The chair moved that the public testimony be closed;
without objection, it was so ordered.
Senator Ogden resumed the chair.
Senator Ogden moved that SB 1004 be left pending;
without objection, it was so ordered.
The chair laid out SB 1335 and recognized the
author, Senator Deuell, to explain the bill.
Senator Deuell sent up a committee substitute; the
chair recognized Senator Deuell to explain the difference between the committee
substitute and the senate bill as filed.

shown on the attached list.
The chair moved that the public testimony be closed;
without objection, it was so ordered.
Senator Ogden moved that SB 1335 be left pending;
without objection, it was so ordered.
The subcommittee report on SB 23 was laid out by
Senator Nelson. Senator Nelson was recognized to explain the subcommittee
report on SB 23.
Senator Nelson sent up a committee substitute; the
chair recognized Senator Nelson to explain the difference between the committee
substitute and the senate bill as filed.
Senator Nelson sent up Committee Amendment 1.
Senator Ogden opened public testimony.

Senator Ogden moved to leave public testimony open
until after session. Without objection, it was so ordered.
Senator Ogden moved that SB 23 be left pending;
without objection, it was so ordered.
Senator Nelson assumed the chair.

author, Senator Ogden, to explain the bill.
Senator Ogden sent up a committee substitute; the
chair recognized Senator Ogden to explain the difference between the committee
substitute and the senate bill as filed.

Senator Nelson, to explain the bill.
Senator Nelson moved adoption of Committee Amendment
1; without objection, the amendment was adopted.
Testimony continued on SB 23.
The chair moved that the public testimony be closed;
without objection, it was so ordered.
Senator Nelson requested unanimous consent to incorporate
the Amendment 1 into the committee substitute; without objection, it was so
ordered. Senator Nelson then moved that the committee substitute be adopted;
without objection, it was so ordered.
The chair laid out as a matter of pending business
SB 1798 and recognized the author, Senator West, to explain the bill.
Senator West sent up a committee substitute; the
chair recognized Senator West to explain the difference between the committee
substitute and the senate bill as filed. Senator West moved adoption of the
committee substitute; without objection, it was so ordered.
Senator West moved that SB 1798 do not pass but that
CSSB 1798 be reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 10 ayes, 1 nay, 0
present not voting, and 4 absent.
Senator Nelson moved that SB 23 do not pass but that
CSSB 23 be reported back to the Senate with the recommendation that it do pass
and be printed. The motion carried with a record vote of 13 ayes, 0 nays, 0
present not voting, and 2 absent.
The chair laid out as a matter of pending business
SB 1505 and recognized Senator Eltife, in the absence of the author, to explain
the bill.
Senator Eltife moved that SB 1505 do not pass but
that CSSB 1505 be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote of 12 ayes, 0
nays, 0 present not voting, and 3 absent.
Senator Hinojosa assumed the chair.
The chair laid out as a matter of pending business
SB 1428 and recognized the author, Senator Ogden, to explain the bill.

requesting to be shown voting aye on SB 23. Without objection, it was so
ordered.
Senator Williams requested to be shown voting aye on
SB 23. Without objection, it was so ordered.
There being no further business, at 4:40 PM Senator
Ogden moved that the Committee stand recessed subject to the call of the chair.
