Pursuant to a notice posted in accordance with
Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on
Finance was held on Wednesday, April 20, 2011, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 10:04 AM.
The following business was transacted:
The chair recognized Senator Shapiro to lay out the
subcommittee report for SB 22. Senator
Shapiro was recognized to explain the subcommittee report.
Senator Shapiro sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
Senator Shapiro sent up Committee Amendment 2 and
moved adoption; without objection, the amendment was adopted.
Senator West sent up Committee Amendment 3 and moved
adoption; without objection, the amendment was adopted.
Senator Duncan sent up Committee Amendment 4.
Senator Ogden moved that SB 22 be left pending;
without objection, it was so ordered.
At 11:14 AM Senator Ogden moved that the Committee
stand recessed subject to the call of the chair. Without objection, it was so
ordered.
At 3:35 the Committee reconvened.

Senator Duncan moved to pull down Committee
Amendment 4. Without objection, it was so ordered.
Senator Duncan sent up Committee Amendment 5 and
moved adoption; The motion carried with a record vote of 12 ayes, 3 nays, 0
present not voting, and 0 absent.
Senator West sent up Committee Amendment 6. Senator West moved to withdraw Committee
Amendment 6. Without objection, it was
so ordered.
Senator Deuell sent up Committee Amendment 7.
Senator Deuell moved to reconsider the motion by
which Committee Amendment 3 as adopted.
The motion failed with a record vote of 5 ayes, 9 nays, 0 present not
voting, and 1 absent.
Senator Deuell moved to withdraw Committee Amendment
7. Without objection, it was so ordered.
Senator Shapiro requested unanimous consent to
incorporate the amendments into the committee substitute; without objection, it
was so ordered. Senator Zaffirini then moved that the committee substitute be
adopted; without objection, it was so ordered. Senator Shapiro moved that SB 22
do not pass but that CSSB 22 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion carried with a record
vote of 11 ayes, 4 nays, 0 present not voting, and 0 absent.

the committee substitute was previously adopted. Without objection, it was so
ordered. Senator Ogden moved to withdraw the committee substitute. Without
objection, it was so ordered.

the chair recognized Senator Ogden to explain the difference between the
committee substitute and the senate bill as filed.
Senator Estes sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
