Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on
Jurisprudence was held on Tuesday, April 12, 2011, in the Betty King Committee
Room at Austin, Texas.

The chair called the meeting to order at 1:30 PM.

At 1:31 PM Senator Huffman assumed the chair.
The chair laid out SB 491 and recognized Senator
Harris, in the absence of the author, to explain the bill.
Witnesses testifying and registering on the bill are
shown on the attached list.
The chair moved that the public testimony be closed;
without objection, it was so ordered.
Senator Harris moved that SB 491 be left pending;
without objection, it was so ordered.
At 1:35 PM Senator Harris resumed the chair.
The chair laid out SB 1159 and recognized the
author, Senator Wentworth, to explain the bill.
Senator Harris sent up a committee substitute; the
chair recognized Senator Wentworth to explain the difference between the
committee substitute and the senate bill as filed.

Senator Harris moved that SB 1159 be left pending;
without objection, it was so ordered.
The chair laid out SB 220 and recognized the author,
Senator Nelson, to explain the bill.

substitute and the senate bill as filed.

without objection, it was so ordered.
Senator Harris moved that SB 1752 be left pending to
await a quorum; without objection, it was so ordered. Upon arrival of a quorum,
Senator Harris moved that SB 1752 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion carried with a record
vote of 7 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Carona and
Senator Huffman submitted a motion in writing requesting unanimous consent to
be shown voting Aye on SB 1752.
Senator Uresti moved that the bill be recommended
for placement on the Local & Uncontested Calendar; without objection, it
was so ordered.

Senator Harris sent up a committee substitute; the
chair recognized Senator Harris to explain the difference between the committee
substitute and the senate bill as filed. Senator Harris moved adoption of the
committee substitute; without objection, it was so ordered.
Senator Gallegos, Jr. moved that SB 1026 do not pass
but that CSSB 1026 be reported back to the Senate with the recommendation that
it do pass and be printed. The motion carried with a record vote of 7 ayes, 0
nays, 0 present not voting, and 0 absent. Senator Carona, Senator Duncan, and
Senator Huffman submitted a motion in writing requesting unanimous consent to
be shown voting Aye on CSSB 1026.
Senator Harris moved that the bill be recommended

At 2:27 PM Senator Harris resumed the chair.
The chair laid out SB 1717 and recognized the
author, Senator Duncan, to explain the bill.
Senator Duncan sent up a committee substitute; the
chair recognized Senator Duncan to explain the difference between the committee
substitute and the senate bill as filed. Senator Harris moved adoption of the
committee substitute; without objection, it was so ordered.
At 2:31 PM Senator Rodriguez assumed the chair.
Senator Harris sent up Committee Amendment 1 and
moved adoption; without objection, the amendment was adopted.
At 2:33 PM Senator Harris resumed the chair.

The chair moved that the public testimony be closed;
without objection, it was so ordered.
Senator Harris requested unanimous consent to
incorporate the amendment into a new committee substitute; without objection,
it was so ordered. Senator Duncan then moved that the new committee substitute
be adopted; without objection, it was so ordered. Senator Duncan moved that SB
1717 do not pass but that the new CSSB 1717 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion carried with a
record vote of 7 ayes, 0 nays, 0 present not voting, and 0 absent. Senator
Carona and Senator Huffman submitted a motion in writing requesting unanimous
consent to be shown voting Aye on the new CSSB 1717.
There being no further business, at 2:55 PM Senator
Harris moved that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
