Pursuant to suspension of Senate Rule 11.10 and
11.18, a public hearing of the Senate Committee on State Affairs was held on
Saturday, May 21, 2011, in the Betty King Committee Room at Austin, Texas.

Senator Fraser, the acting chair called the meeting
to order at 9:10 AM. The following
business was transacted:
The chair laid out HB 628 and, in the absence of the
Senate sponsor, explained the bill. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the public testimony
be closed; without objection, it was so ordered. Senator Fraser moved that HB
628 be left pending; without objection, it was so ordered.
The chair laid out HB 2595 and, in the absence of
the Senate sponsor, explained the bill. Witnesses testifying and registering on
the bill are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered. Senator Fraser moved
that HB 2595 be left pending; without objection, it was so ordered.

upon arrival of a quorum; without objection, it was so ordered.
At 9:35 AM Senator Duncan reconvened the
meeting.

HB 628. Senator Jackson moved that HB 628 be reported favorably to the Senate
with the recommendation that it do pass and be printed. The motion carried with
a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.

HB 2595. Senator Van de Putte moved that HB 2595 be reported favorably to the
Senate with the recommendation that it do pass and be printed. The motion
carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1

reported back to the Senate with the recommendation that it do pass and be

placement on the Local & Uncontested Calendar; without objection, it was so
ordered.

Senate with the recommendation that it do pass and be printed. The motion

committee substitute; the chair recognized Senator Van de Putte to explain the
difference between the committee substitute and the senate bill as filed.
Senator Duncan moved adoption of the committee substitute; without objection,
it was so ordered. Senator Van de Putte
moved that HB 2728 do not pass but that CSHB 2728 be reported back to the
Senate with the recommendation that it do pass and be printed. The motion
carried with a record vote of 7 ayes, 1 nay, 0 present not voting, and 1
absent.

HCR 50 in lieu of SCR 14. Senator
Jackson moved that HCR 50 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion carried with a record
vote of 5 ayes, 3 nays, 0 present not voting, and 1 absent.

reconsider the motion by which HB 2098 previously failed. The motion carried with a record vote of 7
ayes, 1 nay, 0 present not voting, and 1 absent. Senator Lucio, Jr. moved that
HB 2098 be reported favorably to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 6 ayes, 2 nays, 0
present not voting, and 1 absent.
There being no further business, at 9:55 AM Senator
Duncan moved that the Committee stand recessed until after adjournment of the
Senate. Without objection, it was so ordered.
At 5:12 PM Senator Duncan reconvened the meeting.

HB 274 and recognized the Senate sponsor, Senator Huffman, to explain the bill.
Senator Huffman sent up a committee substitute; the chair recognized Senator
Huffman to explain the difference between the committee substitute and the
senate bill as filed. Senator Duncan moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses testifying and
registering on the bill are shown on the attached list. The chair moved that
the public testimony be closed; without objection, it was so ordered. Senator
Huffman moved that HB 274 do not pass but that CSHB 274 be reported back to the
Senate with the recommendation that it do pass and be printed. The motion
carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0
absent.
There being no further business, at 5:40 PM Senator
Duncan moved that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
