A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a moratorium on development of land located near the |
|
state's largest Mexican free-tailed bat population. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 212, Local Government |
|
Code, is amended by adding Section 212.905 to read as follows: |
|
Sec. 212.905. MORATORIUM ON DEVELOPMENT NEAR BAT CAVE |
|
PRESERVE. A municipality shall impose a moratorium on the |
|
development of land located in the municipality or the |
|
municipality's extraterritorial jurisdiction that is within five |
|
miles of a nature preserve that is the site of the state's largest |
|
Mexican free-tailed bat population until a study of the |
|
development's environmental effects is completed. The requirements |
|
and limitations of Subchapter E do not apply to a moratorium imposed |
|
under this section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect on the 91st day after the last day of the |
|
legislative session. |
