A BILL TO BE ENTITLED
 
AN ACT
  relating to a moratorium on development of land located near the
  state's largest Mexican free-tailed bat population.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 212, Local Government
  Code, is amended by adding Section 212.905 to read as follows:
         Sec. 212.905.  MORATORIUM ON DEVELOPMENT NEAR BAT CAVE
  PRESERVE. A municipality shall impose a moratorium on the
  development of land located in the municipality or the
  municipality's extraterritorial jurisdiction that is within five
  miles of a nature preserve that is the site of the state's largest
  Mexican free-tailed bat population until a study of the
  development's environmental effects is completed. The requirements
  and limitations of Subchapter E do not apply to a moratorium imposed
  under this section.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect on the 91st day after the last day of the
  legislative session.
