Amend HB 502 (house committee printing) by striking all below the enacting clause and substituting the following:
SECTION 1. Subtitle D, Title 3, Occupations Code, is amended by adding Chapter 268 to read as follows:
CHAPTER 268. CERTIFICATION OF DENTAL ASSISTANTS
Sec. 268.001. DEFINITION. In this chapter, "teeth whitening" means the use of a chemical or other material, tool, product, service, or procedure to whiten human teeth. The term does not include the use by an ultimate consumer of a teeth whitening product sold over the counter.
Sec. 268.002. CERTIFICATION REQUIRED. (a) A person may not engage in the practice of teeth whitening unless the person is a licensed dentist or a licensed or certified dental hygienist or a dental assistant certified by the board to engage in the practice of teeth whitening.
(b) The board shall adopt rules to implement this chapter, including rules establishing qualifications for certification under this chapter.
SECTION 2. The State Board of Dental Examiners shall adopt rules to implement Chapter 268, Occupations Code, as added by this Act, not later than November 1, 2013.
SECTION 3. (a) Except as provided by Subsection (b) of this Section, this Act takes effect January 1, 2014.
(b) Section 2 of this Act takes effect September 1, 2013.
