Amend HB 502 (house committee printing) by striking all below the enacting clause and substituting the following:

SECTION 1. Subtitle D, Title 3, Occupations Code, is amended by adding Chapter 268 to read as follows:

CHAPTER 268. TEETH WHITENING

Sec. 268.001. DEFINITION. In this chapter, "teeth whitening" means the use of a chemical or other material, tool, product, service, or procedure to whiten human teeth. The term does not include the use by an ultimate consumer of a teeth whitening product sold over the counter.

Sec. 268.002. PERFORMANCE OF TEETH WHITENING. (a) A person may not engage in the practice of teeth whitening unless the person is a licensed dentist or a cosmetic dental technician.

SECTION 2. This Act takes effect September 1, 2013.
