Amend HB 912 on third reading in SECTION 2 of the bill as follows:
(1) In added Section 423.001, Government Code, as amended by Second Reading Amendment No. 1 by Gooden, strike "privately owned".
(2) Strike added Section 423.001(a), Government Code, as amended by Second Reading Amendment No. 1 by Gooden and by the Second Reading Amendment by Johnson, and substitute the following:
(a) A person commits an offense if the person uses an unmanned vehicle or unmanned aircraft to capture an image of:
(1) an individual or privately owned real property in this state with the intent to conduct surveillance on the individual or property captured in the image; or
(2) real property in this state, on which a primary or secondary school or a licensed child-care facility is operated or an individual located on that property, with the intent to conduct surveillance.
(3) In added Section 423.003(c), Government Code, in the language added by Second Reading Amendment No. 2 by Gooden, strike "private property" each place it appears and substitute "real property."
