Amend HB 1294 (house committee printing) as follows:
(1) On page 1, strike lines 13-20 and substitute the following:
evidence satisfactory to the court that:
(1) at the time of the offense:
(A) the defendant was not arrested or issued a citation for violation of any other offense;
(B) the defendant did not possess a child passenger safety seat system in the vehicle; and
(C) the vehicle the defendant was operating was not involved in an accident; and
(2) subsequent to the time of the offense, the defendant obtained [the defendant possesses] an appropriate child passenger safety seat system for
(2) Add the following appropriately numbered SECTION to the bill and renumber subsequent SECTIONS of the bill accordingly:
SECTION ____. Section 545.412(b), Transportation Code, is amended to read as follows:
(b) An offense under this section is a misdemeanor punishable by a fine of not more than [$25 for the first offense and not more than] $250 [for a second or subsequent offense].
