Amend CSSB 614 (senate committee report) as follows:
(1) In SECTION 1 of the bill, in added Section 44.002, Utilities Code (page 1, line 37), strike "and".
(2) In SECTION 1 of the bill, in added Section 44.002, Utilities Code (page 1, line 39), between "adopted" and the period, insert the following:
; and
(5) has approved the application of this chapter to the county as provided by Section 44.004
(3) In SECTION 1 of the bill, in added Section 44.003(a), Utilities Code (page 1, lines 41-42), strike "in the general revenue fund".
(4) In SECTION 1 of the bill, in added Section 44.003(a), Utilities Code (page 1, line 42), strike "commission" and substitute "commissioners court of a county to which this chapter applies".
(5) In SECTION 1 of the bill, in added Section 44.003(b), Utilities Code (page 1, line 46), strike "commission" and substitute "commissioners court of a county to which this chapter applies by order".
(6) In SECTION 1 of the bill, in added Section 44.003(b), Utilities Code (page 1, line 48), between "cooperatives" and "to", insert "that provide service to a county that has approved the application of this chapter to the county as provided by Section 44.004".
(7) In SECTION 1 of the bill, in added Section 44.003(c), Utilities Code (page 1, line 53), strike "commission" and substitute "commissioners court of a county to which this chapter applies by order".
(8) In SECTION 1 of the bill, in added Section 44.003(d), Utilities Code (page 2, line 1), strike "commission by rule" and substitute "commissioners court of a county to which this chapter applies by order".
(9) In SECTION 1 of the bill, in added Section 44.003(e), Utilities Code (page 2, line 5), strike "commission" and substitute "commissioners court of a county to which this chapter applies".
(10) In SECTION 1 of the bill, in added Section 44.003(e), Utilities Code (page 2, line 6), strike "commission's".
(11) At the end of SECTION 1 of the bill, in added Chapter 44, Utilities Code (page 2, between lines 9 and 10), add the following:
(f) The commissioners court of a county to which this chapter applies may consult with the commission concerning the provision of energy assistance under this chapter.
Sec. 44.004. APPROVAL OF COMMISSIONERS COURT. (a) A commissioners court of a county by order may approve the application of this chapter to the county.
(b) A commissioners court of a county must hold a public hearing at which a member of the public may present testimony before the commissioners court approves the application of this chapter to the county.
