Amend CSSB 1387 (senate committee report) as follows:
(1) In SECTION 1 of the bill, in added Section 1901.001(13-a), Occupations Code (page 1, line 29), between "wells" and "who", insert ", or a qualified employee of a groundwater conservation district,".
(2) Add the following appropriately numbered SECTIONS to the bill and renumber the SECTIONS of the bill accordingly:
SECTION ____. Section 1902.001, Occupations Code, is amended by adding Subdivision (8-a) to read as follows:
(8-a) "Third-party inspector" means a qualified employee of a state agency with jurisdiction over wells, or a qualified employee of a groundwater conservation district, who assists the department with enforcement activities.
SECTION ____. Subchapter I, Chapter 1902, Occupations Code, is amended by adding Section 1902.405 to read as follows:
Sec. 1902.405. THIRD-PARTY INSPECTORS; ENFORCEMENT. The department may contract with a third-party inspector to assist in the enforcement of this chapter or a rule adopted under this chapter, including rules governing the performance of inspections and the conduct of investigations.
