BACKGROUND AND PURPOSE

 

Recent legislation provided that certain facilities and other licensees may be denied a license to open another facility if a previous license was revoked, suspended, or terminated. H.B. 159 seeks to include abortion facilities among those facilities.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 159 amends Section 531.951(a), Government Code, as added by Chapter 1051 (S.B. 78), Acts of the 82nd Legislature, Regular Session, 2011, to include an abortion facility licensed under the Texas Abortion Facility Reporting and Licensing Act among the entities subject to regulation by a health and human services agency with respect to the final licensing, listing, or registration decisions of the agency.

 

EFFECTIVE DATE

 

September 1, 2013.
