BACKGROUND AND PURPOSE

 

As part of its ongoing statutory revision project, the Texas Legislative Council nonsubstantively codifies session law relating to the creation of water districts and assigns that law to code chapters in the Special District Local Laws Code, but interested parties assert that the council cannot do so in some cases when there are ambiguities in the session law. The McMullen Groundwater Conservation District session law contains ambiguity regarding director election dates. C.S.H.B. 776 seeks to resolve this issue by codifying district provisions and providing for a uniform election date.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 776 amends the Special District Local Laws Code to codify and update provisions relating to the McMullen Groundwater Conservation District, including the establishment of a uniform election date in November of each odd-numbered year for the directors' election.

 

C.S.H.B. 776 amends Sections 1(a) and 2(a), Chapter 1331, Acts of the 76th Legislature, Regular Session, 1999, to make conforming changes.

 

C.S.H.B. 776 repeals the following provisions:

·         Part 6, Article 3, Chapter 966, Acts of the 77th Legislature, Regular Session, 2001

·         Chapter 1378, Acts of the 77th Legislature, Regular Session, 2001

 

EFFECTIVE DATE

 

September 1, 2013.
