BACKGROUND AND PURPOSE
A "minor" currently is defined in the Alcoholic Beverage Code as a person under 21 years of age. Interested parties have raised concerns regarding statutory provisions making an individual's civil liability for the provision of alcohol to a minor applicable only to alcohol provided to a minor under the age of 18, and note that these two provisions create an inconsistency in the law. H.B. 1013 seeks to correct this inconsistency.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 1013 amends the Alcoholic Beverage Code to extend the civil liability of an adult 21 years of age or older for damages proximately caused by the intoxication of a minor to include liability for damages proximately caused by the intoxication of a minor under the age of 21, rather than under the age of 18.

EFFECTIVE DATE
On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
