AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1179 amends current law relating to the payment of restitution for the taking of wildlife resources without the property owner's consent.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 61.022, Parks and Wildlife Code, by adding Subsection (b-1), as follows:

 

(b-1) Requires a court to order a defendant convicted of an offense under this section (Taking Wildlife Resources Without Consent of Landowner Prohibited) to make restitution to the owner of the land, submerged land, or water.  Prohibits restitution under this section from including a payment for the value of wildlife or wildlife remains.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: upon passage or September 1, 2013.
