BACKGROUND AND PURPOSE

 

Interested parties contend that the professional prosecutors law was intended to enhance public prosecutions in Texas and encourage state prosecutors to devote all of their efforts to representing the state by compensating such prosecutors with a state salary equal to that of a district judge. H.B. 1278 seeks to apply such law to the district attorney for the 79th Judicial District in Brooks and Jim Wells Counties. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1278 amends the Government Code to include the district attorney for the 79th Judicial District among the state prosecutors who are subject to statutory provisions governing professional prosecutors.

 

EFFECTIVE DATE

 

September 1, 2013.
