AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Concern has been expressed over the requirement that a concealed handgun license applicant provide the applicant's Social Security number to the Department of Public Safety of the State of Texas (DPS) when applying for the license. Interested parties contend that a Social Security number is mainly used for federal government purposes and should not be mandated or connected to the state's application for a concealed handgun license because it is not necessary to complete a background check and because other identifying information, such as the person's name and birth date, are provided.
H.B. 1349 amends current law relating to information that may be requested by the Department of Public Safety from a person applying for or renewing a concealed handgun license.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 231.302, Family Code, by amending Subsection (c) and adding Subsection (c-1), as follows:
(c) Provides that, except as provided by Subsection (c-1), to assist in the administration of laws relating to child support enforcement under Parts A and D of Title IV of the federal Social Security Act (42 U.S.C. Sections 601-617 and 651-669), certain criteria must be fulfilled. Makes nonsubstantive changes.
(c-1) Provides that, for purposes of issuing a license to carry a concealed handgun under Subchapter H (License to Carry a Concealed Handgun), Chapter 411 (Department of Public Safety of The State of Texas), Government Code, the Department of Public Safety of the State of Texas (DPS) is not required to request, and an applicant is not required to provide, the applicant's social security number.
SECTION 2. Amends Section 411.174, Government Code, by adding Subsection (d), to prohibit DPS from requesting or requiring an applicant to provide the applicant's social security number as part of an application under this section.
SECTION 3. Amends Section 411.185, Government Code, by adding Subsection (e), to prohibit DPS from requesting or requiring a license holder to provide the license holder's social security number as part of an application under this section.
SECTION 4. Provides that the change in law made by this Act applies only to an application for the issuance or renewal of a license to carry a concealed handgun submitted on or after the effective date of this Act. Provides that an application submitted before the effective date of this Act is governed by the law in effect when the application was submitted, and the former law is continued in effect for that purpose.
SECTION 5. Effective date: September 1, 2013.
