AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In addition to federal regulation by the Food and Drug Administration, dental laboratories in Texas are currently regulated by two state agencies: the Department of State Health Services and the Texas State Board of Dental Examiners.

 

H.B. 1395 addresses this duplicative state regulation by exempting dental laboratories that are registered with the Texas State Board of Dental Examiners from also having to obtain licensure with the Department of State Health Services.

 

H.B. 1395 amends current law relating to the exemption of registered dental laboratories from certain distributing and manufacturing licensing requirements.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 431.273, Health and Safety Code, by adding Subsection (a-1), to provide that a person is exempt from licensing under this subchapter (Device Distributors and Manufacturers) if the person holds a registration certificate issued under Chapter 266 (Regulation of Dental Laboratories), Occupations Code, and engages only in conduct within the scope of that registration.

 

SECTION 2.  Effect date: September 1, 2013.
