AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Certain municipalities have a government in which three aldermen act as the city council. In the current Government Code, these aldermen can apply for a special meeting but it is the mayor in the end who decides whether the special meeting occurs or not.
H.B. 1734 requires that a special meeting be held upon the application of the three aldermen, regardless of the mayor's approval or lack thereof. This amendment to the Government Code will equalize the division of power between the mayor and the aldermen and develop a fairer form of city government.
H.B. 1734 amends current law relating to the authority of the mayors of certain municipalities to call a special meeting.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 22.038(b), Local Government Code, to authorize the mayor to call a special meeting on the mayor's own motion and require the mayor to call a special meeting on the application of three aldermen.
SECTION 2. Effective date: upon passage or September 1, 2013.
