AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, public institutions of higher education are required to seek approval from the Texas Higher Education Coordinating Board in order to acquire certain property.  The University of Texas System would like authorization to acquire a tract of land at the eastern edge of The University of Texas at Arlington campus as it becomes available for the purpose of redeveloping the area to complement the College Park district development and other adjacent improvements.

 

H.B. 1753 seeks to provide this authorization to the board of regents of The University of Texas System.

 

H.B. 1753 amends current law relating to authorizing the board of regents of The University of Texas System to acquire certain property in the city of Arlington.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Authorizes the board of regents of The University of Texas System (board) to acquire by purchase, exchange, gift, or otherwise, for campus expansion and other university purposes of The University of Texas at Arlington, all or part of the property in the city of Arlington, Tarrant County, Texas, that is included within the area within certain boundaries.  Sets forth the boundaries of the tract of land in the city of Arlington, Tarrant County. 

 

SECTION 2.  Requires that the title to the land be taken in the name of the board and be subject to the control and management of the board in the manner and to the extent that the property  now owned by The University of Texas System in fee simple is held and controlled.

 

SECTION 3.  Provides that this Act does not grant the state or The University of Texas System the power of eminent domain over the property.

 

SECTION 4.  Effective date: upon passage or September 1, 2013.
