BACKGROUND AND PURPOSE

 

Currently, public institutions of higher education are required to seek approval from the Texas Higher Education Coordinating Board in order to acquire certain property. The University of Texas System would like authorization to acquire a tract of land at the eastern edge of The University of Texas at Arlington campus as it becomes available for the purpose of redeveloping the area to complement the College Park district development and other adjacent improvements. C.S.H.B. 1753 seeks to provide this authorization to the board of regents of The University of Texas System.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 1753 authorizes the board of regents of The University of Texas System to acquire by purchase, exchange, gift, or otherwise, for campus expansion and other university purposes of The University of Texas at Arlington, all or part of the property in the city of Arlington, Tarrant County, Texas, that is included within the area with boundaries specifically described by the bill. The bill requires the title to the property to be taken in the name of the board and to be subject to the control and management of the board in the manner and to the extent that the property now owned by the university system in fee simple is held and controlled. The bill expressly does not grant the state or the university system the power of eminent domain over the property.

On passage, or, if the bill does not receive the necessary vote, September 1, 2013.

THENCE North along South Mesquite Street to the intersection of South Mesquite Street and UTA Boulevard;

THENCE West along E.Border Street to the beginning intersection at the corner of E.Border Street and South Center Street.

SECTION 1. The board of regents of The University of Texas System may acquire by purchase, exchange, gift, or otherwise, for campus expansion and other university purposes of The University of Texas at Arlington, all or part of the property in the city of Arlington, Tarrant County, Texas, that is included within the area with the boundaries specifically described as follows:

SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2013.
