AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The University of Texas Southwestern Medical Center is currently referenced in statute as The University of Texas Southwestern Medical Center at Dallas, although in practice, the institution does not reference the City of Dallas on printed materials related to the institution.  H.B. 1844 seeks to align statute with practice by eliminating "at Dallas" from the institution's official name in statute.

 

H.B. 1844 amends current law relating to the official name of The University of Texas Southwestern Medical Center.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 51.821(4), Education Code, to redefine "participating medical school" for this section.

 

SECTION 2.  Amends Section 55.1722(a), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 3.  Amends Section 55.1732(a), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 4.  Amends Section 55.1742(c), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 5.  Amends Section 55.1752(a), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 6.  Amends Section 61.003(5), Education Code, to redefine "medical and dental unit" for this section.

 

SECTION 7.  Amends Section 63.002(c), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 8.  Amends Section 63.101(a), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 9.  Amends Section 65.02(a), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 10.  Amends the heading to Subchapter C, Chapter 74, Education Code, to read as follows:

 

SUBCHAPTER C.  THE UNIVERSITY OF TEXAS SOUTHWESTERN MEDICAL CENTER

 

SECTION 11.  Amends Section 74.101, Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 12.  Amends Section 154.002(a), Education Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 13.  Amends Section 572.003(c), Government Code, as follows:

 

(c) Changes a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.  Provides that "appointed officer of a major state agency" means:

 

(1)-(14) Makes no change to these subdivisions;

 

(15) a member of the governing board of a public senior college or university as defined by Section 61.003, Education Code, or of The University of Texas Southwestern Medical Center, The University of Texas Medical Branch at Galveston, The University of Texas Health Science Center at Houston, The University of Texas Health Science Center at San Antonio, The University of Texas M. D. Anderson Cancer Center, rather than the University of Texas System Cancer Center, The University of Texas Health Science Center at Tyler, University of North Texas Health Science Center at Fort Worth, Texas Tech University Health Sciences Center, Texas State Technical College--Harlingen, Texas State Technical College--Marshall, Texas State Technical College--Sweetwater, or Texas State Technical College--Waco;

 

(16)-(23) Makes no change to these subdivisions;

 

(24) the Texas Medical Board, rather than the Texas State Board of Medical Examiners;

 

(25)-(31) Makes no change to these subdivisions;

 

(32) the Health and Human Services Commission, rather than the Texas Board of Health; or

 

(33)-(35) Makes no change to these subdivisions.

 

Deletes existing text providing  that "appointed officer of a major state agency" means a member of the Texas Department of Economic Development; the Texas Workers' Compensation Commission; the Texas Board of Mental Health and Mental Retardation; the Texas Board on Aging; or the Texas Board of Human Services.  Makes nonsubstantive changes.

 

SECTION 14.  Amends Section 102.154(a), Health and Safety Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 15.  Amends Section 121.102, Health and Safety Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 16.  Amends Section 155.104(b), Occupations Code, to change a reference to The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

SECTION 17.  (a) Changes the name of The University of Texas Southwestern Medical Center at Dallas to The University of Texas Southwestern Medical Center.

 

(b) Provides that a reference in law to The University of Texas Southwestern Medical Center at Dallas means The University of Texas Southwestern Medical Center.

 

(c) Provides that an appropriation for the use and benefit of The University of Texas Southwestern Medical Center at Dallas is available for the use and benefit of The University of Texas Southwestern Medical Center.

 

(d) Requires the board of regents of The University of Texas System and The University of Texas Southwestern Medical Center at Dallas to ensure that the change of the name made by this Act is implemented with as little unnecessary cost as possible.  Requires the medical center to, to the maximum extent practicable, use all stationery and other consumable supplies that are printed with the institution's former name and are in its possession on the effective date of this Act.

 

SECTION 18.  Effective date: September 1, 2013.
