BACKGROUND AND PURPOSE

 

Interested parties contend that the McCulloch County Hospital District and its board of directors are seeking to amend the process by which the board may lease a district-owned hospital or facility to a person and the process by which notice of an election of district directors is published. H.B. 1920 seeks to address these issues by establishing provisions relating to the election and authority of the district's board of directors.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 1920 amends the Special District Local Laws Code to require notice of an election of directors of the McCulloch County Hospital District to be published in a newspaper with general circulation in the district in accordance with Election Code provisions prescribing the method of giving notice, rather than requiring notice of the election to be published one time in such a newspaper not earlier than 30 days or later than 10 days before the election date.

 

H.B. 1920 authorizes the district's board of directors by resolution to order the lease of a hospital or other facility owned by the district to any person. The bill requires the resolution to include a finding by the board that the lease of the hospital or facility is in the best interest of district residents.
